Nyetimber Wedding Terms and Conditions

1. These terms and conditions (‘Wedding Terms’) govern the sale and supply of products by Nyetimber Limited, a company registered in England and Wales with company number 05509845 (“Nyetimber”), to customers for delivery within the United Kingdom (each a “Customer”) as part of the wedding packages which are advertised from time to time by Nyetimber on Nyetimber.com and/or via separate Nyetimber wedding brochure) (‘Wedding Packages’).
2. The Nyetimber Terms and Conditions of Sale relating to use of the Webstore do not apply.
3. We take personal data matters seriously, please see our Privacy Policy here for more information on how we hold information.
4. The following defined terms apply to these Wedding Terms:

‘Confirmation Email’ means an email communication from Nyetimber email address weddingwines@nyetimber.com confirming Nyetimber’s acceptance of a Wedding Order from the Customer, which will contain confirmation of the Customer’s preferred date of delivery or a proposed delivery date and a unique reference number as well as invoice with payment instructions;

‘Contract’ means the contract for the purchase and supply of products pursuant to a Wedding Package between the Customer and Nyetimber, which is formed on acceptance of a Wedding Order by Nyetimber pursuant to a Confirmation Email;

‘Personalisation’ means a hand calligraphed inscription on a bottle (as applicable) showing the two first names of the celebrating couple (or such other wording as agreed with Nyetimber – Nyetimber having absolute discretion to approve or not, any alternatives).

‘Products’ means styles of Nyetimber English Sparkling Wine and/or other products and/or experiences made available as part of a Wedding Package;

‘Wedding Orders’ means any order placed by a Customer by emailing weddingwine@nyetimber.com with a completed Wedding Order Form to purchase, and for Nyetimber to supply, Products pursuant to a Wedding Package.

‘Wedding Order Form’ is the form available by emailing weddingwine@nyetimber.com

1. All Wedding Orders must be placed by emailing weddingwine@nyetimber.com and not via our Webstore.  Wedding Orders are not available to Customers wishing to arrange delivery of Wedding Orders to the Channel Islands, the Isle of Man or other destinations outside the United Kingdom.
2. Only persons over the legal age to purchase alcohol in the UK may access or purchase Wedding Packages from Nyetimber. Nyetimber will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18, and reserves the right to refuse to accept a Wedding Order in its sole discretion if it has reason to believe the Customer is under 18, or the Customer intends to supply Products to under-18s. By placing a Wedding Order, the Customer confirms that he or she is at least 18 years old.

Wedding Orders

1. By placing a Wedding Order, the Customer agrees to be bound by these Wedding Terms, which will be updated from time to time at Nyetimber’s sole discretion. Individuals who are not prepared to agree to be bound by these Wedding Terms do not have permission to access Wedding Packages.
2. It is the Customer’s responsibility to ensure that any information provided via the Wedding Order is accurate and complete. The Customer’s placement of a Wedding Order is entirely at its own risk save only where the Customer sustains loss or damage as a direct result of Nyetimber’s negligence or to the extent liability cannot be limited in law.
3. Each Wedding Order placed by a Customer shall be deemed an offer and shall be subject to acceptance by Nyetimber by way of a Confirmation Email. Nyetimber may refuse to accept a Wedding Order for any reason. On receipt of a Confirmation Email, the Customer shall become bound by these Wedding Terms.
4. If a Wedding Order cannot be accepted for any reason (including for example but without limitation non-availability or withdrawal of a Product) Nyetimber will promptly notify the Customer via email and, wherever possible, offer a replacement or a refund as appropriate.
5. All Wedding Orders are subject to Nyetimber’s receipt of a valid debit or credit card authorisation from the Customer. Full payment for the Products pursuant to a Wedding Order is to be made within 30 days of receipt of the Confirmation Email.
6. Title in the Products supplied to a Customer shall not pass until full payment has been made for the Products at the price specified in the relevant Confirmation Email. In any case of non-payment or chargebacks by a Customer, Nyetimber shall be entitled to repossess or trace the Products or the proceeds of sale in the Customer’s and enter onto any of the premises where the materials are located in order to exercise this right.
7. In respect of all Wedding Orders shipped, the risk in the Products shall pass to the Customer immediately on delivery.
8. No Products will be processed for Personalisation or shipped for delivery until full payment is received by Nyetimber for that Wedding Order.

Personalisation

1. The Personalisation requested by the Customer in respect of any Personalised Products comprising part of any Promotional Offer as part of a Wedding Order must not , in the opinion of Nyetimber, be:

1. 1. illegal or offensive in any way;
   2. infringe a third party’s rights (including intellectual property rights such as copyright or trademarks);
   3. encourage excessive or irresponsible consumption of alcohol;
   4. present abstinence or moderation in a negative way;
   5. advertise or promote direct sale or offer of any product of any kind or nature;
   6. be connected in any way to a commercial/advertising/corporate purpose (unless with our prior consent).

Nyetimber may refuse to provide Personalised Products comprising a Promotional Offer where, in the opinion of Nyetimber, the Personalisation requested is in breach of this term.

Pricing

1. All quoted Product prices are inclusive of UK VAT.  Promotional offers and prices are as stated, with no further discounts available.
2. Whilst every effort is made to ensure any published price of Products is accurate, Nyetimber cannot guarantee pricing will be correct in all circumstances or that all Products on the Nyetimber website will be available at all times. In the event of a pricing error, Nyetimber will either contact the Customer to offer the option of a replacement, a refund or fulfilment of the Wedding Order at the correct price. Nyetimber will not in any event be obliged to supply Products at an incorrect price.
3. Nyetimber reserves the right to adjust prices and offers on Products at its discretion before acceptance of a Wedding Order. Where an end date for an offer is specified on the Nyetimber website it is intended for guidance purposes only.

Delivery

1. Nyetimber will undertake to arrange delivery (excluding weekends and bank holidays) free of charge for all Wedding Orders of 30+ bottles, on a date agreed with the Customer.
2. The Customer’s preferred date for delivery of the Products pursuant to a Wedding Order should be included in the Wedding Order. Nyetimber shall confirm the date for delivery in the Confirmation Email (whether that is the preferred Customer date in the Wedding Order or an alternative date as close to it as possible).
3. Please be aware that during peak periods or periods of adverse weather conditions, delivery times may take longer.
4. Products being Personalised may also take longer than other Products to ship or may ship separately to other Products comprising a Wedding Order.
5. For orders comprising less than 60 bottles in a Wedding Order, Nyetimber’s courier offers delivery on Monday to Friday between 8am to 6pm. If the courier is unable to successfully deliver they will either leave the Customer’s Wedding Order in a safe place or leave instructions for re-booking delivery. A signature will be required and, at the courier’s discretion, a suitable form of ID, which the Customer must be ready to present on delivery of all Wedding Orders. If the Customer is unable to comply with these requirements for any reason, the courier will be unable to deliver the Wedding Order and Nyetimber will not be responsible for any re-delivery charges arising as a result of having to rearrange delivery.
6. For orders comprising 60 bottles or more in any Wedding Order, Nyetimber’s courier offers delivery on Monday to Friday at a specified time, usually during the morning. We will contact you to agree a time. If the courier is unable to deliver at the agreed time, the courier will not leave the Customer’s Wedding Order in a safe place or leave instructions for re-booking delivery. Where delivery takes place, a signature will be required and, at the courier’s discretion, a suitable form of ID, which the Customer must be ready to present on delivery of all Wedding Orders. If the Customer is unable to comply with these requirements for any reason, the courier will be unable to deliver the Wedding Order and Nyetimber will not be responsible for any re-delivery charges arising as a result of having to rearrange delivery.
7. Any delivery dates supplied following acceptance of a Wedding Order are given in good faith and in the expectation that Nyetimber will be able to fulfil them. Notwithstanding this, the Customer accepts that time is not the essence and Nyetimber shall be under no liability for loss, damage or expense suffered by the Customer or any third party arising from the failure of Nyetimber to deliver on any specified date or time or place.
8. Neither Nyetimber nor its courier will be held liable for any loss or damage suffered by a Customer as a result of the courier carrying out delivery instructions given by a Customer and the Products being subsequently lost or stolen.
9. Nyetimber is unable to deliver to the Channel Islands, the Isle of Man or destinations outside the UK.

Returns and Cancellation

1. The Customer has a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the Contract within fourteen (14) days after the date the relevant Wedding Order was accepted. However, Nyetimber is only obliged to reimburse the cost of returning items where they were delivered in error, or the Products were damaged or defective. Please refer to the Personalisation Terms & Conditions concerning personalised products.
2. Should the Customer elect to cancel a Wedding Order, all charges will be refunded within fourteen (14) days of the Products being returned, provided they are in a saleable condition. The Customer must make arrangements for the collection of the Wedding Order within fourteen (14) days of notifying Nyetimber of its intention to cancel the Contract, failing which Nyetimber may decline to accept the Products or process the Customer’s refund request.
3. In the event that the Customer elects to cancel a Wedding Order, Nyetimber reserves the right to charge the Customer for the cost of any Personalised Products, save that we will provide refunds or exchanges where Personalised Products supplied are not of satisfactory quality or fit for purpose. If you have received a personalised product that is not of satisfactory quality or fit for purpose, please contact us.
4. If the Customer wishes to exchange a Product, additional shipping charges may apply together with the difference (if any) between the prices of the original and the replacement Product.
5. In addition Nyetimber will provide a full refund or replacement for any Products which are defective or not as described. In such event, the Customer has a period of thirty (30) days, starting from the date of delivery of the Order, to reject any Product contained in the Order. This condition does not affect the Customer’s statutory rights.
6. Nyetimber may require defective Products (or not as described) to be returned to be returned, in which case it will arrange a convenient collection time with the Customer.
7. Any return/refund or exchange requests, or questions concerning Nyetimber’s returns and cancellation policy, should be addressed via email to weddingwine@nyetimber.com.

Promotional Offers

1. From time to time we may offer promotional deals and/or free gifts via the Wedding Packages (a “Promotional Offer”). In order to take advantage of a Promotional Offer, you must notify us on or before the time you place a Wedding Order.
2. Where a Promotional Offer is subject to a minimum Product Wedding Order, any free items will not count towards the relevant Wedding Order.
3. In the event a Customer qualifies for a Promotional Offer involving a minimum Product Wedding Order and subsequently decides to return items from the Wedding Order, Nyetimber will be entitled to charge the Customer the full retail price of the free Product(s).
4. Promotional Offers are subject to availability. Nyetimber reserves the right to exchange free Products or other items comprising part of a Promotional Offer for another item of at least equivalent value.
5. Promotional Offers are limited to one per Customer and cannot be exchanged, transferred or substituted for cash.
6. Free gifts comprising part of a Promotional Offer will generally be despatched at or around the same time as the qualifying Order. If this is not possible, we will notify you in writing and provide an estimated delivery or fulfilment date.
7. Nyetimber reserves the right to amend or withdraw a Promotional Offer, or the terms applicable to a Promotional Offer, in its absolute discretion and at any time.

Complaints

1. Complaints should be addressed via email to weddingwine@nyetimber.com. Any complaints should quote the relevant Order number and as much detail as possible concerning the Customer’s grounds for complaint. All complaints will be acknowledged within five (5) working days and Nyetimber will undertake to resolve the issue within a further five (5) working days. Each complaint will be treated as confidential and addressed by a member of Nyetimber’s team who will have overall responsibility for the matter.

Nyetimber Liability

1. Nyetimber shall not be liable for:

1. a) The failure to perform any obligation if such failure was caused by circumstances beyond Nyetimber’s control; or
   b) Delay howsoever caused in performing any obligation; or
2. c) Interruption or delay in fulfilling its obligations hereunder by reason of implementing a change to a Wedding Order requested by the Customer.

1. Any implied warranties or conditions in respect of Products or other services supplied by Nyetimber, save only for those provided under the Sale of Goods Act 1979, are hereby expressly excluded and Nyetimber shall not be liable for any loss injury or damage arising directly from the use, application or storage of such Products except where such liability cannot be limited in law. Without prejudice to the foregoing Nyetimber may be prepared to consider claims concerning the quality of the Products (including, at Nyetimber’s sole discretion, arranging for replacement thereof) provided that such claims are notified to Nyetimber in writing within thirty (30) days of receipt of the Products by the Customer and are limited to the invoice value of the Products.  However, Nyetimber expressly excludes liability for any such claims arising by reason of defects caused by the wilful or accidental damage, negligence or incorrect storage on the part of the Customer.
2. All claims for damage to, or partial loss of Products in transit must be submitted in writing to Nyetimber within three (3) working days of delivery. In the case of non-delivery of the whole Order, claims must be submitted in writing to Nyetimber within seven (7) working days of receipt by the Customer of notification of despatch of Products.  In the absence of notification of claims within the terms mentioned above the Products shall be deemed to have been delivered in accordance with the Customer’s Order.
3. The supply of Products pursuant to a Wedding Order are only intended for domestic and private use. The Customer agrees that he or she will not use the Products for any commercial, business or re-sale purposes, and Nyetimber will have no liability in respect of any loss of profit, loss of business, business interruption or loss of business opportunity in any circumstances whatsoever.
4. Customers should be aware of the following inherent risks related to the consumption of alcohol:

• Alcohol should always be consumed in moderation;
• The Products are heavy and extra care should be taken when lifting;
• Sparkling wines can be volatile due to the build-up of gas and extra care should be taken when uncorking, including angling the bottle away from the face and eyes.

42. Nyetimber and the Customer confirm their intent not to confer any rights on any third parties by virtue of the Contracts (Rights of Third Parties) Act 1999.
43. The Contract shall be governed by and continued in accordance with the laws of England and Wales and in particular the provisions of the Licensing Act 2003 with regard to the minimum legal age for the consumption of alcohol. The Customer hereby submits to the exclusive jurisdiction of the courts of England and Wales.
44. Nyetimber Toast Wedding Package

The following terms apply specifically to the ‘Nyetimber Toast’ Wedding Package:

1. Minimum order of x60 75cl bottles of Nyetimber Classic Cuvee Multi Vintage and/or any other Nyetimber main range wines.
2. The Customer shall receive one Personalised complimentary magnum of Classic Cuvee Multi Vintage, along with the Nyetimber bottle stopper.

45. Prestigious Toast Wedding Package

The following terms apply specifically to the ‘Nyetimber Prestigious Toast’ Wedding Package:

1. Minimum order of x30 75cl bottles of Nyetimber 1086 and/or Nyetimber 1086 Rose.
2. The Customer shall receive one Personalised complimentary magnum of Rose 1086, along with a Nyetimber bottle stopper.

46. Nyetimber Experience Wedding Package

The following terms apply specifically to the ‘Nyetimber Experience’ Wedding Package:

1. Minimum order of x120 75cl bottles of Nyetimber Classic Cuvee Multi Vintage and/or any other Nyetimber main range wines.
2. The Customer shall receive one Personalised complimentary magnum of Classic Cuvee Multi Vintage and two Nyetimber Open Day Tickets.
3. Open Day Tickets subject to availability and also subject to the Open Day Terms and Conditions Numbers 3 to 23.

47. Prestigious Experience Wedding Package

The following terms apply specifically to the ‘Nyetimber Prestigious Experience’ Wedding Package:

1. Minimum order of x60 75cl bottles of Nyetimber 1086 and/or Nyetimber 1086 Rose.
2. The Customer shall receive a complimentary private tour of the Nyetimber Vineyard for up to six members of the wedding party (which shall include a wine tasting) on a date to be agreed with Nyetimber and subject to availability.
3. Supplementary/additional places on the private tour may be arranged for an additional fee but are at the discretion of Nyetimber.
4. Those visiting Nyetimber on the private tour are subject to complying with the same terms as those set out here in respect of open days.

48. Nyetimber Favours Wedding Package

The following terms apply specifically to the ‘Nyetimber Favours’ Wedding Package:

1. Minimum order of x60 5cl bottles of Nyetimber Classic Cuvee Mulit Vintage.
2. The Customer shall receive complimentary Nyetimber tags and ribbons in the same quantity as the number of 37.5cl bottles above.

49. Virtual Tasting Wedding Package

The following terms apply specifically to the ‘Nyetimber Virtual Tasting’ Wedding Package:

• The Virtual Tasting will last approximately 1 to 2 hours in length.
• No food or photography will be provided.
• The tasting will take place via Zoom or Teams.
• Dates and times are subject to availability and at Nyetimber discretion.
• You will be guided in the tasting by one of the Nyetimber Brand Ambassadors.
• You must all be over 18 years of age.
• Pricing as follows:
  1. Two Nyetimber main range wines

Prices from £75 per delivery address/household

1. Three Nyetimber main range wines

Prices from £105 per delivery address/household

1. Two Prestige Cuvee wines

Prices from £260 per delivery address/household

50. In-Person Tasting Wedding Package

The following terms apply specifically to the ‘Nyetimber In-Person Tasting’ Wedding Package:

• The In-Person Tasting will last approximately 1 to 2 hours in length.
• No food or photography will be provided.
• The tasting can take place at either our Mayfair Office (8 Sackville Street, London W1S 3DG) or Nyetimber Vineyard (Gay Street, West Sussex RH20 2HH), dates and times are subject to availability and will only be available during the hours of 9 to 17.30 Monday to Friday.
• You will be guided by one of the Nyetimber Brand Ambassadors.
• Minimum number of x2 people required per in person-tasting, up to a maximum of x6 people. Additional individuals subject to Nyetimber approval.
• It will be a private event and you will not be sharing the tasting with other couples/individuals.
• You must both be over 18 years of age. Attendance at the Mayfair Office and/or Nyetimber Vineyard is subject to complying with the same terms as those set out here in respect of open days.
• Pricing as follows:
  1. Three Nyetimber main range wines

Prices from £50 per person

1. Four Nyetimber main range wines

Prices from £60 per person

1. Two Prestige Cuvee wines

Prices from £80 per person

51. The Nyetimber Engagement Shoot Package

The following terms apply specifically to the ‘Nyetimber Engagement Shoot’ Wedding Package:

• There shall be two options, a half day (£600) and full day package (£1,000), subject to availability, timing and dates to be agreed with Nyetimber.
• The experience includes access to the Nyetimber Vineyard (Gay Street, West Sussex RH20 2HH) for an engagement photoshoot.
• The package includes a tasting of three Nyetimber English Sparkling Wines hosted by a Nyetimber Brand Ambassador.
• The happy couple will also be gifted a bottle of Nyetimber Classic Cuvee Multi-Vintage 75cl.
• In addition, on the full day experience a delicious three course meal will also be served. Dietary needs will be accommodated of course.
• Half day shoots will be held between 09:00-12:00, Monday-Friday.
• Full day shoots will be held between 09:00-17:00, Monday -Friday.
• Photography costs/costs of a photographer are excluded from the cost of this package.
• No images of people (other than the Customers) or images of the The Manor House and Gardens at the Nyetimber Vineyard shall be permitted.
• The Customer shall comply with the reasonable instructions of the Nyetimber team from time to time whilst on the Nyetimber Vineyard.
• No guests shall be permitted (in addition to the happy couple and their photographer) without the prior approval of Nyetimber.
• Happy couple has full usage rights of the images (in terms of Nyetimber feature) subject to any third party rights, complying with all laws regulations and requirements in respect of imagery/video featuring alcohol and/or an alcohol brand and on the basis the imagery/video is for personal and non-commercial use only.
• Guests must be 18 years of age. Attendance at the Nyetimber Vineyard is subject to complying with the same terms as those set out here in respect of open days.

52. The Nyetimber Bus Wedding Proposal Package

The following terms apply specifically to the ‘Nyetimber Bus Wedding Proposal’ Package.

1. Price on application.
2. No overnight stays will be permitted on the Nyetimber bus.
3. No more than x2 individuals will be permitted onto the Nyetimber bus at any time (in addition to a Nyetimber representative).
4. Up to x4 hours of time on the Nyetimber bus, per day of hire. There may be other limitations on times (such as no use after 8pm) to be agreed on a case by case basis.
5. You must at all times comply with the reasonable instructions of use by Nyetimber staff for your and the teams health, safety and well being.
6. Photography, food and drinks not included.
7. The bus hire is only available for use as a dinner location for two Customers. The bar will not be available for general use for parties, as a bar or as a reception venue.
8. Bus only available for hire whilst stationary (not in motion).
9. Customer to receive during the hire, a 75cl bottle of Classic Cuvee Multi Vintage and a special bouquet of flowers. No cash alternative.
10. Price to be agreed on a case by case basis and shall vary depending on mileage, whether an overnight stay is required (bus parked over night in a location), alcohol/event licensing costs, costs associated with parking or other location fees, permit costs.
