Instagram August Promotion – T&Cs

These are the terms and conditions (“Rules”) that apply to the ‘Nyetimber – Win a bottle of Blanc de Blancs promotion’ (“Promotion”).  By entering the Promotion, each entrant agrees to these Rules and confirms they have read and understood the Nyetimber Privacy Policy at https://nyetimber.com/privacy/

1. The promoter is Nyetimber Limited (a company with number 05509845) whose registered address is Nyetimber Vineyard, Gay Street, West Chiltington, Sussex RH20 2HH, Tel. +44 (0) 207 734 8490, Fax. +44 (0) 207 292 0841, nyetimber.com (“Nyetimber”)
2. The Promotion is open to legal residents of the United Kingdom (England, Scotland, Wales and Northern Ireland).
3. The following individuals are not eligible to enter the Promotion
   – Nyetimber employees and individuals engaged by Nyetimber;
   – Members of their immediate family and/or household (whether related or not) to any of those individuals
   – Anyone else professionally involved with the operation or administration of the Promotion
4. All entrants must be over 18 to enter and be able to prove you are of legal age to drink if requested by Nyetimber.
5. To participate in this Promotion, entrants must follow @nyetimber on Instagram, ‘like’ the promotional post on the @nyetimber Instagram post relating to the Promotion and make a comment in the comments section of the @nyetimber Instagram post relating to the Promotion.
6. This competition will run until 00:00 (UK time) on 25th  August 2021.
7. Entries made by direct reply to this T&C page will not be accepted.
8. There is one prize consisting of 1x 75cl bottle of Blanc de Blancs 2014 which will be supplied as arranged with the Promoter (“Prize”).
9. There will be x1 winner in total across the Promotion. The winner will be picked at random from all eligible entries and will be notified by email and/or their Instagram account from @Nyetimber only, by 27th August 2021.
10. We reserve the right to provide an alternative Prize(s) of equal or greater value in the event of unforeseen circumstances.
11. No purchase is necessary, however, you will need an internet connection and access to Instagram. No refund may be claimed for expenses incurred in participating in the promotion, including in relation to the use of the internet.
12. We reserve the right to exclude any entries which we believe to be inappropriate, fraudulent or based on misconduct or in violation of Instagram’s own terms of use.
13. The Prize(s) is non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part. The prize does not include food or any additional beverages beyond those listed in point 8 above.
14. The winner will have 24 hours to claim their Prize(s) from the time that they are contacted via their email and/or Instagram account (where contacted by both email and Instagram, the time of the later of the two) with notification that they are a winner. After this time we reserve the right to select a new winner. Nyetimber will make reasonable efforts to contact the winner, but it is the winner’s responsibility to monitor their Instagram and email account, including any junk folder, for receipt of notification.
15. The decisions of Nyetimber are final and no correspondence will be entered into.
16. The Prize(s) will be delivered to the winner within a reasonable timescale after claiming the Prize(s). No bulk, automated or multiple entries will be accepted.
17. Personal Data: By taking part in this Promotion, all entrants consent to us collecting, storing and using their personal data submitted with their entry for the purposes of this Promotion, including as necessary in respect of the administration of the Promotion.
18. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation.
19. Entrants have certain rights in relation to their personal data, including: (i) to obtain copies of it; (ii) to have it corrected or deleted; (iii) to limit the way in which it is used; (iv) to object to its use; (v) to transfer it; (vi) not to be subject to decisions based on automated processing (including profiling); and (vii) to complain to the regulator, the UK Information Commissioner’s Office. Please note that many data subject rights are not absolute and the extent to which they apply may vary depending on the circumstances and any exemptions that may apply.
20. Liability – Nyetimber will not be liable for: (i) any loss that is not caused by Nyetimber (or any person acting on Nyetimber’s behalf); (ii) any loss caused by any event or circumstance beyond Nyetimber’s reasonable control; (iii) any loss of profits or revenue, loss of anticipated savings or loss of goodwill; or (iv) any unavailability of the Nyetimber website. However, nothing in these Rules limits or excludes any person’s liability for death or personal injury caused by negligence, for fraud or for any matter for which it would be illegal to limit or exclude liability.
21. In particular, consumers have legal rights in relation to products that are faulty or not as described and services which are not performed with reasonable care and skill and these legal rights are in addition to and are not affected in any way by anything contained in these Rules. Further advice about consumer rights is available from any local Citizens’ Advice Bureau (https://www.citizensadvice.org.uk/) or local Trading Standards office (https://www.gov.uk/find-local-trading-standards-office).
22. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. You are providing your information to Nyetimber and not to Instagram. By participating in this Promotion, you agree to a complete release of Instagram from any claims.
23. By entering this Promotion, each entrant acknowledges that in the event of a win their surname and county of residence may be disclosed to persons enquiring, where permitted by law. Any entrant may object to their information being made available in this way or may request that the amount of information made available be reduced, by contacting Nyetimber using the contact details at the end of these Rules. In these circumstances, the entrant acknowledges that Nyetimber may nevertheless disclose the relevant information, and the entrant’s entry, to the UK’s Advertising Standards Authority if required to do so. This may happen where Nyetimber is required to demonstrate that it has awarded the Prize(s) advertised. To request disclosure of winners’ details, enquirers must submit a request to info@nyetimber.com by 4/9/2021. Details will only be disclosed (if permitted by law) after the Prize(s) has been validly claimed.
24. Nyetimber does not accept responsibility for entries that are lost, damaged or delayed. For example, as a result of network, system development, computer or telecommunications failures or fault of any kind – including any hardware, programming code, databases or software used in the Promotion.
25. The winner may be required to participate in reasonable related publicity without further reward. e.g. Winners may have their name shared with a short statement provided by the winner about their win. Each entrant agrees that in the event of a win, Nyetimber will be able to use the winner’s name and image in connection with such publicity on its corporate website, blogs or its Facebook, Instagram or Twitter account.
26. Nyetimber reserves the right to vary, cancel or amend, without notice, this Promotion in the event of any unforeseen circumstances outside of its reasonable control.  In the event of cancellation, the Prize(s) may be awarded to a winner drawn from eligible entries received prior to cancellation.
27. Entrants should be aware of the following inherent risks related to the consumption of alcohol:

• Alcohol should always be consumed in moderation
• The Nyetimber sparkling wine bottles are heavy and extra care should be taken when lifting;
• Sparkling wines can be volatile due to the build-up of gas and extra care should be taken when uncorking, including angling the bottle away from the face and eyes.
